Exploration in the Andean countries: Legal framework and required permits

The presentation details the legal forms and permits required to successfully carry out exploration campaigns to Latin countries: Argentina, Chile, Ecuador and Peru.

The speakers are attorneys practicing in their respective area of expertise in Montt Group SpA, a regional professional company with subsidiaries in the four countries and involved in the subject matter.

The situation in each country will be addressed in separate presentations that will provide information about the legal forms, required authorizations and permits necessary to carry out exploration activities, as well as the need to create permanent establishments or companies in order to perform such activities, legal vehicles available and their tax treatment.

Each presentation will contain references to the following issues:
• Establishment of exclusive exploration rights in specific areas;
• Obtaining environmental permits from the appropriate Government bodies. Restrictions due to the existence of protected areas;
• Mining easements or authorizations from the owners of the surface land;
• Special authorizations and sectorial permits issued by the Safety Regulator on mining exploration facilities and its methods;
• Foreign investment rules; tax benefits, availability of temporary admission regimes for equipment and the legal protections for the holder of the mining rights in order to ensure the possibility of consolidating exploitation rights.
• Regime for expatriates, their taxes and limitations for foreign workforce.
