e3 Plus: A Framework for Responsible Exploration
The Prospectors and Developers Association of Canada (PDAC) launched e3 Plus – A Framework for Responsible Exploration in order to help exploration companies continuously improve their social, environmental and health and safety performance and to comprehensively integrate these three aspects in to all their exploration programs.   

It is a voluntary guideline designed to help inform explorers in their decision-making while engaged in exploration projects around the world. The Framework is available online, for free, at www.pdac.ca/e3plus.

The acronym e3 Plus reflects the exploration industry’s aspiration for triple excellence in the fields of: social responsibility; environmental stewardship; and health and safety. e3 Plus follows on from the PDAC’s highly-regarded website, e3 – Environmental Excellence in Exploration which focused on environmental stewardship and community engagement. e3 Plus is the only website of its kind specifically designed for the exploration industry.   

Phase I of e3 Plus consists of principles, guidance and three toolkits. The principles and guidance are designed to answer the questions “What is expected of us and why?”. The question “How do we do it?” is answered by the three toolkits.  

Phase II of the Framework will consist of performance indicators, reporting guidelines and certification and the PDAC will begin working on this phase later this year.    
 
 
AME BC Guidebook on Mineral Exploration, Mining & Aboriginal Community Engagement

Supreme Court of Canada and the Duty to Consult
On November 18, 2004, the Supreme Court of Canada announced its judgments in Haida v. British Columbia and Taku River Tlingit First Nation v. British Columbia. In a commentary on the judgments, Charles F. Willms and Kevin O’Callaghan of Fasken Martineau state that the court gave guidance to the provincial government on the test for consultation. In both cases, the court emphasized that the consultation process requires good faith and reasonableness on the part of the provincial government and aboriginal people, and that the duty of consultation did not provide a veto to aboriginal people. Ontario Government Draft Guidelines
On June 26, 2006, the Ontario Secretariat for Aboriginal Affairs released draft guidelines for use by Ministries on Consultation with Aboriginal Peoples related to Aboriginal Rights and Treaty Rights. Click here for a copy.
 
 
Saskatchewan Consultation Policy Framework
The Government of Saskatchewan First Nation and Métis Consultation Policy Framework (Consultation Policy Framework) presents the Government of Saskatchewan's policy on consultation with First Nations and Métis communities for use by Government ministries, agencies, Crown corporations, First Nations, Métis and proponents.

It includes the Duty to Consult Policy, a section on the policy's application to decisions affecting lands and resources, a policy context section and a section on interest-based engagement.

This policy takes effect June 2010, replacing the Government of Saskatchewan Interim Guide for Consultation with First Nations and Métis People. It will be reviewed and updated when required to ensure consistency with case law, legislation and/or policy.
 
 
Québec Government Guidelines and Strategies
Over the years, several government departments, agencies and corporations have developed Aboriginal community consultation practices. The aim of this guide is to define more clearly the guidelines set forth by the Supreme Court of Canada on this subject.

The drafting of Plan Nord results from the need to establish a partnership linking local communities, the government, and other stakeholders. It is based on the values of respect, awareness and openness. The partners—First Nations, Inuit, municipalities, civil society and the business sector—will work together with the government to define new opportunities for the generations to come. Together, they will define a project bearing promise for the future, a source of pride for the whole of Québec society.
